These Terms of Service (“Terms”) govern your use of the Station 34 Pilates website, mobile app, booking platform, in-studio services, memberships, packages, classes, communications, and related services.
Station 34 Pilates (“Station 34 Pilates,” “Station 34,” “we,” “our,” or “us”) provides in-person Pilates and fitness classes. We do not currently offer online classes and we do not sell retail products through our website or app.
By creating an account, booking a class, purchasing a membership or package, attending class, using our website or app, or otherwise using our services, you agree to these Terms.
If you do not agree to these Terms, you should not use our website, app, booking platform, or studio services.
1. Studio Services
Station 34 Pilates offers in-person Pilates and fitness classes, private or semi-private sessions if available, memberships, packages, and related studio services.
Our services are fitness and wellness services. They are not medical care, physical therapy, diagnosis, treatment, rehabilitation, or medical advice.
You are responsible for determining whether participation is appropriate for you. If you have any medical condition, injury, pain, pregnancy/postpartum concern, recent surgery, physical limitation, or other health concern, you should consult a licensed healthcare provider before participating.
2. Client Account
To book classes, purchase services, or use certain website or app features, you may be required to create an account through our booking platform or app.
You agree to provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your login information.
You are responsible for all activity under your account.
You agree to notify us promptly if you believe your account has been accessed without authorization.
We may suspend or terminate access to your account if we believe your account has been misused, if your information is inaccurate, if payment fails, or if you violate these Terms or our studio policies.
3. Booking and Attendance
Classes must be booked through our website, app, booking platform, or another approved method.
Class capacity is limited.
Reservations are available on a first-come, first-served basis unless otherwise stated.
You are responsible for managing your bookings, cancellations, waitlist status, and account activity.
We may cancel, modify, substitute, or reschedule classes, instructors, class formats, or class times when necessary due to staffing, safety, weather, maintenance, emergencies, low enrollment, or other business reasons.
4. Waitlists
If a class is full, you may be able to join the waitlist.
If a spot opens, you may be added to the class according to the booking platform’s waitlist process and notification settings.
You are responsible for monitoring your app, email, text, or account notifications.
If you are added to a class from the waitlist and do not attend or cancel within the required time frame, the applicable late-cancel or no-show policy may apply.
5. Late Arrival Policy
For safety and to avoid disrupting class, clients should arrive on time.
If you arrive late, we may deny entry to class at our discretion.
Late arrival may be treated as a late cancel or no-show depending on timing, safety concerns, instructor discretion, and studio policy.
We reserve the right to refuse participation if we believe it would be unsafe or disruptive for you to join after class has begun.
6. Cancellation, Late-Cancel, and No-Show Policy
You are responsible for canceling any class you cannot attend.
A cancellation is considered late if it occurs within 8 hours of the scheduled class start time.
Late cancels and no-shows may result in loss of class credit, package deduction, late-cancel fee, no-show fee, or other consequence according to your membership, package, or studio policy.
We may waive a late-cancel or no-show consequence at our discretion, but we are not required to do so.
Repeated late cancels or no-shows may result in restrictions on booking privileges or account access.
7. Memberships
Station 34 Pilates may offer recurring memberships that provide access to a certain number of classes or services during a billing cycle.
Membership terms, pricing, class allotments, contract length, billing frequency, cancellation requirements, renewal terms, and other conditions are provided at the time of purchase or in a separate membership agreement.
By purchasing a membership, you agree to the specific terms presented at checkout or in the membership agreement.
Memberships may be billed automatically on a recurring basis.
Memberships are personal to the client and may not be transferred, shared, sold, or assigned unless we agree in writing.
Unused classes, credits, or benefits may expire according to the applicable membership terms.
8. Recurring Billing and Automatic Payments
By purchasing a recurring membership or other automatically billed service, you authorize Station 34 Pilates and/or our third-party payment processor to charge your payment method according to the billing frequency, amount, and terms disclosed at the time of purchase.
Billing may occur every four weeks, monthly, or according to the specific membership or package terms shown at checkout.
Your payment method may be charged automatically until the membership is canceled, expires, or is otherwise terminated according to the applicable terms.
You are responsible for keeping your payment method current.
If your payment fails, we may attempt to process the payment again, contact you for updated payment information, suspend booking privileges, assess applicable fees where allowed, cancel bookings, or terminate your membership or account.
Recurring membership terms, cancellation policies, and instructions for cancellation will be provided in a manner that can be retained by you.
9. Automatic Renewal Notice
Some memberships or services may renew automatically unless canceled according to the applicable cancellation policy.
Before purchasing an automatically renewing membership or service, you will be provided the material renewal terms, including the recurring charge amount, billing frequency, cancellation policy, and how to cancel.
By purchasing an automatically renewing membership or service, you consent to recurring billing according to those terms.
You may cancel according to the cancellation instructions provided at purchase, in your account, in the app, or by contacting us using the contact information listed below, subject to any required notice period, minimum commitment, early termination fee, or other membership-specific terms.
10. Membership Cancellation
Membership cancellation requirements depend on the membership you purchased.
Unless a different written policy applies to your specific membership, clients must provide at least 30 days’ notice to cancel a recurring membership.
Cancellation requests must be submitted through the method we provide, which may include the website, app, booking platform, email, or another written method.
If your membership has a minimum commitment, contract term, promotional term, or early termination fee, those terms will apply.
A cancellation request does not automatically refund prior charges, late-cancel fees, no-show fees, used services, unused services, or fees already incurred unless required by law or expressly stated in your membership terms.
Because Tennessee law may impose specific requirements on certain health-club agreements and automatically renewing services, Station 34 Pilates will process cancellation requests in accordance with applicable law.
11. Early Termination of Contract Memberships
If you purchase a contract-based membership with a minimum commitment, early cancellation may be subject to an early termination fee.
Unless your specific membership terms state otherwise, the early termination fee is equal to one billing cycle of your contract membership price.
The early termination fee is separate from any final billing amount due during the required cancellation notice period.
For example, if a 30-day cancellation notice applies, one additional billing cycle may be charged during the notice period, and the early termination fee may also apply if you are ending a contract membership before the end of the agreed term.
Any legally required cancellation rights will be honored.
12. Packages and Class Credits
Station 34 Pilates may sell class packages, class credits, or drop-in classes.
Package terms, expiration dates, pricing, included classes, transferability, refundability, and restrictions are provided at purchase.
Packages and credits are personal to the client and may not be shared, transferred, sold, or assigned unless we agree in writing.
Expired, unused, or partially used credits are not refundable unless required by law or expressly stated in the package terms.
13. Pricing and Changes
We may change prices, membership options, package options, fees, schedules, class types, instructors, and studio offerings at any time.
Price changes will not affect charges already completed, but may affect future purchases, renewals, or billing cycles where permitted by law and according to applicable membership terms.
If a price change applies to an automatically renewing membership, we will provide notice where required by law.
14. Refunds
All purchases are final unless otherwise stated in writing or required by law.
We do not guarantee refunds for unused classes, unused packages, late cancels, no-shows, missed classes, expired credits, failure to attend, schedule conflicts, relocation, illness, injury, or dissatisfaction with a class or instructor.
We may provide credits, extensions, exceptions, or refunds at our discretion, but doing so in one situation does not require us to do so in another.
Refunds, if approved, may be returned to the original payment method or issued as account credit.
15. Freezes, Holds, and Extensions
Membership freezes, account holds, package extensions, or medical pauses may be offered at our discretion or according to your membership terms.
We may require documentation for medical or other special requests.
Approval of a freeze, hold, or extension is not guaranteed unless required by law or expressly included in your membership terms.
16. Health, Safety, and Assumption of Risk
You understand that Pilates, strength training, stretching, resistance training, and physical movement involve inherent risks, including discomfort, muscle soreness, dizziness, falls, strains, sprains, aggravation of existing conditions, or other injuries.
You agree to participate within your own ability and to stop immediately if you experience pain, dizziness, shortness of breath, chest pain, unusual symptoms, or any concern about your safety.
You are responsible for informing instructors of any injury, limitation, pregnancy/postpartum status, recent surgery, medical condition, or other relevant concern before class.
You understand that instructors may offer general modifications, but those modifications are not medical advice.
You participate voluntarily and assume the risks associated with participation.
17. Waivers and Intake Forms
Before participating, you may be required to complete a liability waiver, health intake form, consent form, or other required documentation.
You agree that the information you provide is accurate and complete to the best of your knowledge.
If your health status changes, you agree to update us before participating.
We may refuse participation if required forms are incomplete, inaccurate, outdated, or if we believe participation may be unsafe.
18. Studio Rules and Conduct
Clients are expected to behave respectfully toward instructors, staff, other clients, visitors, and the studio space.
You agree not to:
Harass, threaten, intimidate, or verbally abuse staff or clients.
Engage in unsafe, disruptive, aggressive, discriminatory, or inappropriate conduct.
Use equipment without instruction or permission.
Attend class while impaired by alcohol, drugs, or any substance that may affect safety.
Record, photograph, or film other clients or staff without permission.
Damage studio property.
Violate studio rules, booking policies, or instructor directions.
We may remove a client from class, suspend booking privileges, terminate a membership, or refuse service if we believe the client’s conduct is unsafe, disruptive, inappropriate, or inconsistent with studio policies.
19. No-Photo and Privacy Policy
Station 34 Pilates may maintain a no-photo or limited-photo policy to protect client privacy.
Clients may not photograph, video record, livestream, or audio record classes, instructors, staff, or other clients.
This includes photos or videos for social media, personal use, marketing, or training.
Violation of this policy may result in removal from class, account suspension, membership termination, or other action.
20. Personal Belongings
You are responsible for your own belongings.
Station 34 Pilates is not responsible for lost, stolen, damaged, or misplaced personal items.
You should not bring valuables into the studio unless you are prepared to keep responsibility for them.
21. Security Cameras
Station 34 Pilates may use security cameras in public or common areas for safety, security, incident review, property protection, and business operations.
Security cameras are not placed in bathrooms, changing areas, or other areas where clients have a heightened expectation of privacy.
By entering the studio, you acknowledge that common areas may be monitored or recorded.
22. Website, App, and Booking Platform Use
You agree to use our website, app, and booking platform only for lawful purposes and in accordance with these Terms.
You may not:
Attempt to interfere with website, app, or booking-platform functionality.
Attempt unauthorized access to accounts, systems, or data.
Use another person’s account without permission.
Submit false, misleading, or fraudulent information.
Use the website, app, or booking system for unlawful, harmful, or abusive purposes.
We may limit, suspend, or terminate access to our website, app, booking platform, or services if we believe these Terms have been violated.
23. Communications
We may contact you by email, phone, text message, app notification, or other communication methods regarding your account, bookings, payments, memberships, required forms, safety issues, policy updates, schedule changes, or other service-related matters.
Marketing or promotional communications may be sent where permitted by law and consistent with your preferences.
You may opt out of marketing communications where available.
Opting out of marketing communications does not stop transactional or service-related communications necessary to provide our services.
Text messaging terms may be provided separately or within our Privacy Policy.
24. Intellectual Property
The Station 34 Pilates name, logo, branding, website content, app content, class descriptions, written materials, policies, graphics, images, videos, documents, and other materials are owned by or licensed to Station 34 Pilates.
You may not copy, reproduce, distribute, modify, sell, publish, or use our materials for commercial purposes without our written permission.
25. Third-Party Services
Our website, app, booking platform, payment processor, email/text tools, and other systems may be operated by third-party providers.
Your use of those services may also be governed by their terms and privacy policies.
We are not responsible for the acts, omissions, outages, errors, data practices, or policies of third-party providers, except where required by law.
26. Promotions, Discounts, and Intro Offers
Promotions, discounts, introductory offers, and special pricing may be subject to additional terms.
We may modify or discontinue promotions at any time.
Promotions may be limited to new clients, first-time purchases, local residents, one per person, or a specific time period.
Promotional purchases may be non-refundable and may expire according to the offer terms.
27. Weather, Emergencies, and Studio Closures
We may cancel or modify classes due to weather, emergencies, power outages, maintenance, instructor illness, safety issues, or other circumstances beyond our control.
If we cancel a class, we may return the class credit, issue account credit, reschedule, or provide another remedy at our discretion.
We are not responsible for transportation costs, lost time, lost wages, childcare costs, or other indirect losses related to a cancellation or closure.
28. Disclaimer of Warranties
Our services are provided on an “as available” and “as is” basis.
We do not guarantee specific fitness, health, medical, weight-loss, strength, flexibility, pain-relief, injury-prevention, or wellness results.
Individual results vary.
We do not guarantee that our website, app, booking platform, or services will be uninterrupted, error-free, secure, or available at all times.
29. Limitation of Liability
To the fullest extent permitted by law, Station 34 Pilates, its owners, employees, instructors, contractors, affiliates, and representatives will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of our website, app, booking platform, studio services, classes, memberships, or facilities.
Nothing in these Terms is intended to limit liability where such limitation is prohibited by law.
30. Indemnification
You agree to indemnify and hold harmless Station 34 Pilates, its owners, employees, instructors, contractors, affiliates, and representatives from claims, damages, losses, liabilities, costs, or expenses arising out of your violation of these Terms, your misuse of our services, your violation of studio policies, your misconduct, or your violation of another person’s rights.
31. Termination or Refusal of Service
We may refuse service, cancel bookings, suspend account access, terminate a membership, or prohibit access to the studio if we believe a client has violated these Terms, failed to pay, provided false information, acted unsafely, harassed staff or clients, violated privacy rules, damaged property, or otherwise created a safety, legal, or business concern.
Termination does not eliminate amounts already owed.
Any legally required rights will be honored.
32. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms, your account, purchases, membership, or use of Station 34 Pilates services will be handled according to applicable law and the dispute-resolution terms, if any, agreed to by the parties.
33. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the “Last Updated” date above.
The current version will be posted on our website and/or made available through our app or booking platform.
Your continued use of our website, app, booking platform, or studio services after updated Terms are posted means you accept the updated Terms, except where additional consent is required by law.
